Terms & Conditions

These Terms & Conditions (“Terms”) govern your access to and use of the Kashva bank statement analysis platform, including the website at kashva.ai and all associated features (collectively, the “Service”), operated by Kashva (“Kashva”, “we”, “our”, or “us”).

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

Kashva is a technology platform that allows users to upload bank statement files (in PDF or CSV format), extract transaction data, and view AI-generated analytics including transaction categorisation, spending breakdowns, and recurring payment detection.

Kashva is not a bank, financial institution, payment service provider, credit reference agency, or regulated financial services firm. Kashva does not hold any licence from the Central Bank of the UAE, the Dubai Financial Services Authority (DFSA), the Financial Services Regulatory Authority (FSRA), or any other financial regulator. Kashva does not connect to your bank accounts, initiate payments, or access live banking data.

You should independently verify any information derived from the Service and, where appropriate, seek advice from a qualified financial professional, accountant, or tax adviser before making financial decisions. Kashva expressly disclaims any liability for loss or damage you may suffer arising out of reliance on Service outputs for any purpose requiring verified accuracy, including but not limited to tax filings, loan applications, investment decisions, or financial reporting.

Transaction categorisation is performed using automated AI processing and may be inaccurate, incomplete, or misclassified. AI-generated categories reflect probabilistic outputs and should not be relied upon as definitive classifications. You can manually override any category from the transactions view. Kashva makes no warranty as to the accuracy, completeness, or fitness for any particular purpose of AI-generated outputs.

To use the Service, you must:

• Be at least 18 years of age;
• Have the legal capacity to enter into a binding agreement;
• Not be prohibited from using the Service under applicable law.

By using the Service, you represent and warrant that you meet these requirements.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at support@kashva.ai if you become aware of any unauthorised access or use of your account.

You may not share your account with others, create accounts by automated means, or create more than one account per person without our prior written consent.

7.1 Ownership

You retain full ownership of the bank statement files and data you upload to the Service (“Your Content”). By uploading Your Content, you grant Kashva a limited, non-exclusive, royalty-free licence to process, store, and transmit Your Content solely for the purpose of providing the Service to you.

7.2 Warranties about Your Content

You represent and warrant that:

• The bank statements you upload belong to you or you have the legal authority of the account holder to upload them;
• Uploading and processing Your Content does not violate any applicable law or any third party’s rights;
• Your Content does not contain malware, viruses, or other harmful code.

7.3 Anonymised Data

Kashva may use anonymised, aggregated data derived from the Service (such as aggregate category distributions and processing statistics) for service improvement and analytics. Such data cannot be used to identify you individually and is not considered personal data.

You must not use the Service in violation of our Acceptable Use Policy, which is incorporated into these Terms by reference.

The Service, including its design, software, algorithms, and content (excluding Your Content), is owned by Kashva and protected by UAE and international intellectual property laws. Nothing in these Terms grants you any rights in the Service other than a limited right to use it in accordance with these Terms.

You must not copy, modify, distribute, reverse-engineer, decompile, or create derivative works from any part of the Service without our prior written consent.

The Service is provided “as is” and “as available”, without warranty of any kind. To the fullest extent permitted by applicable law, Kashva disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or free from harmful components, that any data will be processed with complete accuracy, or that any defects will be corrected.

To the fullest extent permitted by applicable law, Kashva and its officers, directors, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of revenue, profits, data, or goodwill, arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claim arising out of or relating to these Terms or the Service will not exceed the greater of: (a) the fees you paid to Kashva in the twelve months preceding the claim; or (b) AED 100 (one hundred UAE Dirhams).

Nothing in these Terms limits liability that cannot be excluded or limited under applicable UAE law, including liability for gross negligence or wilful misconduct.

You agree to indemnify, defend, and hold harmless Kashva and its affiliates, officers, directors, and employees from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the Service; (b) Your Content; (c) your violation of these Terms; or (d) your violation of any applicable law or third-party rights.

You may close your account at any time. We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for violation of these Terms or our Acceptable Use Policy, or if we have reason to believe your use poses a risk to us, other users, or third parties.

Upon termination, your right to use the Service ceases immediately. We will delete your data in accordance with our Privacy Policy.

We may modify, suspend, or discontinue any part of the Service at any time. We may also update these Terms from time to time. For material changes, we will provide at least 30 days’ notice by email or by a prominent notice on the Service. Continued use of the Service after the effective date of any change constitutes your acceptance of the revised Terms.

These Terms are governed by and construed in accordance with the laws of the United Arab Emirates. The parties submit to the non-exclusive jurisdiction of the courts of Dubai for any dispute not referred to arbitration.

Any dispute arising out of or in connection with these Terms, including any question regarding their existence, validity, or termination, shall be referred to and finally resolved by arbitration under the Arbitration Rules of the Dubai International Arbitration Centre (DIAC). The seat of arbitration shall be Dubai. The language of the proceedings shall be English.

These Terms, together with the Privacy Policy, Cookie Policy, and Acceptable Use Policy, constitute the entire agreement between you and Kashva regarding the Service and supersede any prior agreements. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force. Our failure to enforce any right or provision does not waive that right. You may not assign your rights under these Terms without our prior written consent.
